As an attorney, getting civil procedure right is fundamental.

There are several consequences for attorneys who do not know correct civil procedure.

These include:

Delays in the legal process

Incorrectly filed or incomplete documents can result in delays in the legal process, which can be costly and time-consuming for clients. This can also result in a loss of credibility for the attorney.

Dismissal of the case

Failing to follow proper procedure can lead to a case being dismissed by the court. Such a dismissal can be fatal to the case, and the client may be left without any legal recourse.

Loss of costs

When an attorney fails to comply with the court rules or procedures, they may be liable for costs. This includes paying the opposing party's legal fees, and other expenses incurred.

Professional misconduct

Failure to follow the correct procedures can lead to a charge of professional misconduct against the attorney. This can result in disciplinary action, including the suspension or revocation of the attorney's license to practice law.

Malpractice claims

If an attorney's negligence results in significant financial or other losses to a client, the client may sue for malpractice.
